Eastbourne Holiday Rentals Terms and Conditions

These Terms and Conditions apply to lettings of holiday accommodation by Eastbourne Holiday Rentals (“Agency”). The Agency acts as agent for the owners of holiday accommodation. The Terms and Conditions form the basis of your contract with the Agency so please read them carefully before making a reservation.

1. Definitions

“Booking Confirmation” means the confirmation of booking provided to the Customer when a booking has been accepted;
“Booking Deposit” means 50% of reservation 
“Booking Form” means the accommodation booking form completed by the Customer;
“Customer” means the person booking holiday accommodation;
“End Date” means the last day of the Rental Period;
“Inventory”

“Owner”
means the inventory of fixtures furniture and effects at the Property a copy of which is kept at the Property;
means the owner of the property
“Property” means the house (and garden, if any) identified in the Booking Form together with the fixtures furniture and effects specified in the Inventory;
“Rent” means the rent specified in the Booking Form;
“Rental Period” means the rental period specified in the Booking Form;
“Security Deposit” means £100
“Start Date” means the first day of the Rental Period.

2. Booking and Payment of Booking Deposit

2.1 By making a booking for one of our properties, the customer agrees that these Booking Terms apply to the property booking. Eastbourne Holiday Rentals acts as an agent on behalf of the property owner and once the booking is confirmed the contract is between the customer and the owner.

2.2 The Customer must pay the Booking Deposit to the Agency at the time of submitting the Booking Form. Payment can be made by debit, credit card or bank transfer at the time the customer makes the booking. A charge of 2.5% may be added to all card payments to contribute to the additional banking charges incurred by Eastbourne Holiday Rentals.

2.3 Once the Agency has received the Booking Form and the Booking Deposit the Agency will send the Customer a Booking Confirmation. At this point a binding contract exists.

2.4 The customer is the person responsible for the booking and is responsible for the conditions of hire. The customer must notify Eastbourne Holiday Rentals of any changes to the number of people or pets (pet friendly properties) staying at the property in writing before the booking commences.

3. Payment of Rent

3.1 The Customer must pay the balance of the Rent due to the Agency at least four weeks before the Start Date.

3.2 If the customer reserves the property less than four weeks before the start date the customer must pay the rent plus the security deposit in full at the time of the booking.

3.3 After full payment is received the customer will be sent confirmation, directions and access details by email. Please read these carefully and contact Eastbourne Holiday Rentals if anything is incorrect.

4. Security Deposit

4.1 The Customer must pay the Security Deposit to the Agency no later than the date on which the balance of the Rent is to be paid.

4.2 The Security Deposit will be held by the Agency and applied against the cost of remedying any damage to the Property caused by the Customer.

4.3 The Security Deposit will be returned to the Customer not more than 7 days after the End Date less any deductions made for the cost of remedying any damage.

5. Cancellation of Booking

5.1 If the Customer cancels the booking more than 8 weeks before the Start Date the Agency shall be entitled to retain a £50 administration fee but the Agency will refund all other sums paid by the Customer.

5.2 If the Customer cancels the booking by giving less 8 weeks notice the following provisions will apply:

5.2.1 cancellation 6 weeks from the Start Date – the Agency retains 50% of the Rent and will refund all other sums paid by the Customer;

5.2.2 cancellation 4 weeks from the Start Date – the Agency retains 100% of the Rent and will refund all other sums paid by the Customer;

5.3 If the Customer has not paid the Rent [and Security Deposit] by the date specified in Clause 3.1 the Customer will be deemed to have cancelled the booking under Clause [5.1].

6. Agency’s obligations during the Rental Period

6.1 The Agency agrees that the Customer may quietly possess and enjoy the Property during the Rental Period without any interruption from the Agency, the owner or any person claiming under or in trust for the owner.

6.2 The Agency shall provide utilities, adequate bed linen and towels at the Property for the number of occupants in each property.

7. Customer’s obligations during the Rental Period

7.1 The Customer shall use the Property in a reasonable and careful manner, not allow it to deteriorate and keep it clean and tidy at all times.

7.2 The Customer shall make good all damage caused to the Property (including the fixtures and fittings) or to any other property through:

7.2.1 any breach of the obligations set out in these Terms and Conditions;

7.2.2 any improper use by or negligence of the Customer or any person at the Property with the Customer’s permission.

7.3 The Customer shall keep the items specified in the Inventory clean and in the same condition as at the commencement of the Rental Period (fair wear and tear and damage by insured risks only excepted) and shall make good or replace with articles of the same sort and equal value such as may be lost broken or destroyed (or at the option of the Agency to pay compensation to the Agency).

7.4 The Customer shall not block or otherwise damage the taps, baths, wash basins, toilets, cisterns or pipes within or exclusively serving the Property.

7.5 The Customer shall keep the Property heated to a reasonable level during the winter months to prevent damage to the Property or the water pipes drains tanks and other plumbing apparatus by cold weather.

7.6 The Customer is legally bound to report to the Agency any damage, destruction, loss, defect or disrepair affecting the Property as soon as it comes to the attention of the Customer.

7.7 The Customer shall place all refuse in the receptacle(s) provided for the Property by the Agency, the owner of the Property or any other competent authority.

7.8 The Customer shall allow the Agency, the owner of the Property or anyone with their written authority together with any workmen and necessary appliances to enter the Property at reasonable times of the day to inspect its condition and state of repair and to carry out any necessary repairs provided the Agency has given reasonable notice (with regard to the work to be undertaken) beforehand and the Customer shall not interfere with or obstruct any such persons.

7.9 The Customer shall in cases of emergency allow the Agency, the owner or anyone with their authority to enter the Property at any time and without notice.

7.10 The Customer shall use the Property as a private holiday residence for a maximum of occupants as confirmed in the booking form.

7.11 The Customer shall not do anything on the Property which may be a nuisance to or cause damage or annoyance to the Agency, the owner of the Property or the tenants or occupiers of any adjoining property.

7.12 The Customer shall not play any musical instrument or other device which can be heard outside the Property after 11pm or before 8am.

7.13 The Customer shall not use the Property for any illegal or immoral purposes.

7.14 The Customer shall not use the Property in a way which contravenes a restriction affecting the freehold (or superior leasehold) title which has been brought to the Customer’s attention.

7.15 The Customer shall not cause or permit any dangerous or inflammable substance to collect in or on the Property apart from those needed for general domestic use.

7.16 The Customer shall not display any notice or advertisement that is visible from outside the Property.

7.17 The Customer shall not keep any animal or pet on the Property without first obtaining the Agency’s written consent and subject to any conditions imposed by the Agency. The customer will be responsible for

7.17.1 Ensuring no pet is left unattended for a lengthy periods in the property or garden

7.17.2 Ensuring that pets are clean and dry before entering the property

7.17.3 Not allowing pets on furniture or into bedrooms

7.17.4 Clearing and disposing of all pet fouling before end date.

Please note we cannot guarantee that non pet friendly properties have never had pets in them before.

7.18 The Customer shall not smoke at the Property.

7.19 The Customer shall comply with any planning conditions affecting the Property which have been brought to the Customer’s attention.

7.20 The Customer shall not assign or sublet the Property or any part of the Property and shall not part with possession or share occupation of the Property or any part of it.

7.21 The Customer shall not permit any person to occupy the Property as a lodger.

7.22 The Customer shall not alter add to or interfere with the appearance structure exterior or interior of the Property or the arrangement of the fixtures furniture and effects.

7.23 At the end of the Rental Period the Customer shall remove the Customer’s belongings from the Property and leave the Property clean and tidy so that the Property is ready for immediate re-occupation. Any personal items left in the property will  be held for two weeks and if unclaimed at this time will be donated to a local charity shop. A minimum fee of £10 plus postage will be required before posting any items back to the customer.

7.24 T he customer must accept responsibility for the safety of their children at all times whilst staying with Eastbourne Holiday Rentals. Children must be accompanied by an adult at all times.

7.25 The customer must adhere to the arrival and departure times provided by the agent on the booking confirmation. Any unsociable check in times will incur a charge which will be advised at the time of booking conformation.

7.26 Stag or hen parties and unaccompanied teenagers are not permitted at any of the properties.

7.27 We ask guests to bring their own beach towels and tea towels. Travel cots and high chairs are available to hire but guests should bring their own baby bedding.

7.28 In the event of a customer locking themselves out of the property a £25 call out charge will be made to access the property. If Eastbourne Holiday Rentals are unable to access the property with their space key and other professionals need to be called the customer will be responsible for any replacement and repair charges incurred.

8. Forfeiture

8.1 If there has been a substantial breach of any of the Customer’s obligations the Agency may on behalf of the owner forfeit (i.e. bring to an end) the tenancy that exists in relation to the Property and may recover possession of the Property. The other rights and remedies of the Agency and the owner will remain in force.

8.2 The owner reserves the right to terminate the customers stay if

8.2.1 There is unreasonable behaviour

8.2.2 They cause a nuisance to other parties or damage the property

8.2.3 If the number of guests exceed the stated occupancy or the property is used for an illegal or commercial activities

9.General

9.1 Any obligation on the Customer in these Terms and Conditions not to do an act or thing includes an obligation not to permit or suffer another person to do such act or thing.

9.2 Whenever there is more than one person comprising the Agency or the Customer their obligations may be enforced against all of them jointly and against each of them individually.

9.3 The Agency and Customer do not intend that the contract between them should be enforceable by any person solely by virtue of the Contracts (Rights of Third Parties) Act 1999 other than the owner of the Property.

9.4 An obligation in these Terms and Conditions to pay money includes an obligation to pay Value Added Tax in respect of that payment.

9.5 Under section 48 of the Landlord and Tenant Act 1987 the Customer is hereby notified that notices (including notices in proceedings) must be served on the landlord by the Customer

9.6 Eastbourne Holiday Rentals, its employees and agents do not accept third party liability in respect of breach of contract, negligence, misrepresentation. Neither the agent or the owner will be liable to the customer or members of their party for any accident, loss, damage, injury, expense or inconvenience that may be incurred in connection with the rental whatsoever suffered or incurred by the occupier. The owner or agent will not be responsible for cancellation due to unusual and unforeseeable circumstances beyond their control i.e. Fire, flood. We recommend the customer insures for such loss.

9.7 If you feel you have reason to complain about the property, you must tell us immediately so the agent / owner can do their best to resolve the issue. The agent / owner must be given the opportunity to remedy any issues that occur at that time.

9.8 Whilst every effort is made to ensure the accuracy of the property details on the website, all descriptions are made in good faith and for guidance only.

9.9 When making payment to Eastbourne Holiday Rentals via bank or BAC transfer please ensure that you check the full details below. Eastbourne Holiday Rentals will not be held responsible for payments paid to other accounts.
